I fixed the issue I was experiencing with the right pane rendering under the center pane.
The issue was in a single HTML Module: there was an HTML table with cells set to specific pixel (px) widths. Once I removed those widths, the right pane rendered properly in IE8.
Of course your issue could be completely different.

Hi Joe and Joe,
Thanks for your help, I upgraded to the latest version and re-created the theme in artisteer 4.1 and it resolved the problem. I then found another one as IE8 and below wouldnt display the header and it turned out to be because there were multiple images so I merged them into one for IE8 and below.... I'm not into microsoft bashing normally but grrrr, i feel the pain all web designers after this!
